TERMS & CONDITIONS

   1.     PURPOSE & ENTIRE AGREEMENT
These Terms & Conditions govern all services provided by Paris Media, including photography sessions, videography services, image editing, video editing, styling services, online galleries and related products.
By booking any service, the Client confirms that they have read, understood and accepted these Terms & Conditions in full.
These Terms & Conditions constitute the entire agreement between Paris Media and the Client and supersede all prior discussions, representations, correspondence or understandings, whether oral or written.
No statement, message or communication shall modify these Terms & Conditions unless expressly confirmed in writing by Paris Media.

   2.     BOOKING, PAYMENT & WITHDRAWAL
Bookings are confirmed upon receipt of the required booking fee.
The booking fee reserves the agreed date and compensates Paris Media for preparation and scheduling work.
The remaining balance must be paid before final delivery of any photographs, videos or digital products.
Additional services, including extra edits, unedited JPEG photographs, unedited video footage, extended coverage or styling services, shall be charged separately.
Travel fees may apply outside Paris city limits.
All displayed prices are subject to a 5% processing fee for online and card payments. Such fees are non-refundable.
Paris Media reserves the right to refuse, suspend or cancel any booking in cases of fraud, abusive conduct, chargeback abuse, bad-faith behaviour or any circumstance deemed harmful to its business.
The Client expressly requests that Paris Media begin performance of the service before the expiry of any applicable withdrawal period and acknowledges that any applicable right of withdrawal may be lost once the service has been fully performed.

   3.     PACKAGES, DELIVERABLES & NON-EXCHANGEABILITY
All packages are sold as complete services.
Package components, locations, deliverables, edited photographs, videos, reels, add-ons and services are not interchangeable, redeemable for cash or exchangeable for alternative services unless agreed in writing.
Unused portions of a package do not give rise to refunds, credits, substitutions or compensation.
Only the deliverables expressly included in the purchased package are guaranteed.
Photography services are delivered in two stages.
The first stage consists of the photo session and the delivery of a private online preview gallery intended exclusively for image selection.
The preview gallery may contain a limited number of low-resolution images selected solely at the discretion of Paris Media. Low-resolution files are delivered at a maximum size of approximately 640 pixels on the longest edge.
The second stage consists of the delivery of high-resolution edited images after the Client has completed their selections and all outstanding balances have been paid.

   4.    PHOTOGRAPHY, VIDEO DELIVERY & EDITING
Photography services are delivered through a private online preview gallery followed by the delivery of edited high-resolution files.
Video services are delivered as final edited products.
All photographs, videos and deliverables are provided digitally only. No prints, albums, framed products or physical products are included or offered.
Preview galleries are generally delivered within three (3) days. Final edited photographs and videos are generally delivered within three to four (3-4) weeks following selection confirmation.
Delivery timelines are estimates only and may vary depending on workload, season and operational requirements.
Where an expedited editing service is purchased, the expedited service shall be deemed fully performed upon delivery of the expedited photographs requested by the Client. Any subsequent revision requests, changes of artistic preference or additional editing requests shall not affect the completion of the expedited service or entitle the Client to any refund, credit or compensation.
Unedited high-resolution JPEG photographs and unedited video footage are not included in any package and may only be purchased at the sole discretion of Paris Media. Paris Media shall determine, at its sole discretion, which photographs are retained, delivered or discarded.
RAW files remain the exclusive property of Paris Media and shall never be delivered, sold or licensed unless expressly agreed in writing by Paris Media.
Standard editing consists of artistic colour grading, tonal adjustments, exposure balancing and global enhancements performed in the signature Paris Media style.
Advanced retouching, body modifications, object removal or extensive revisions are not included unless expressly agreed and paid for separately.
The final artistic interpretation, composition, framing, cropping, exposure, colour grading, retouching and editing style remain entirely at the sole discretion of Paris Media.
Paris Media may, at its sole discretion, accept or refuse any request to modify the editing style, artistic direction or deliverables after editing has commenced. If such a request is accepted, any standard or expedited delivery timeline shall no longer apply. The revised delivery timeline shall depend on workload and operational requirements and cannot be guaranteed.
If the Client requests unedited JPEG photographs instead of the edited photographs included in a package, Paris Media may, at its sole discretion, provide the unedited JPEG photographs as a substitute. Such substitution shall constitute full performance of the corresponding editing obligations for those images. No refund, credit or discount shall apply.
The Client acknowledges that such substitution is final and may not later request both the substituted unedited JPEG photographs and the corresponding edited photographs unless expressly agreed in writing by Paris Media.
Any revision or substitution accepted by Paris Media shall be provided solely as a courtesy unless otherwise agreed in writing and shall not create any ongoing obligation or entitlement to further revisions.
Clients may not alter, edit, filter or manipulate delivered content without prior written consent from Paris Media.
Paris Media shall not be responsible for variations in colour, brightness, contrast or appearance resulting from differences between screens, printers, devices or display settings.

   5.     SCHEDULING, DELAYS & SESSION TIMING
The Client is expected to arrive on time.
The Client is responsible for arriving at the agreed meeting location.
The Client agrees to maintain reasonable flexibility regarding timing.
Any delay caused by the Client shall be deducted from the booked session duration.
Session duration includes all time allocated to the service, including meeting, preparation, transportation between locations, outfit changes, breaks, administrative matters and photography activities.
If the Client arrives more than thirty (30) minutes late, Paris Media may consider the booking a no-show and terminate the session without refund.
The Client remains responsible for the full cost of the booked service regardless of actual shooting time completed.
Once a session has started, the full booked duration shall be deemed earned and payable in full, even if the Client chooses to shorten, interrupt or terminate the session early.
No refund, credit, extension or compensation shall be granted due to Client lateness or early departure.
Session durations are approximate maximum durations. The Client purchases a professional photography service and the corresponding package deliverables, not a guarantee that the full estimated session duration will always be used. Paris Media may conclude a session before the scheduled end time when sufficient content has been captured or when the objectives of the session have been achieved. Such decision shall not give rise to any refund, credit or compensation.
Package deliverables associated with the purchased package may nevertheless remain available at the sole discretion of Paris Media and shall not create any entitlement to a refund.
Session schedules are indicative only and may vary or be affected by weather, traffic, public events, location restrictions, security measures, transport disruptions or other circumstances beyond the reasonable control of Paris Media.

   6.     COMMUNICATION & MEETING RESPONSIBILITY
The Client is responsible for remaining reachable on the day of the session through the same communication channel used during the booking process unless otherwise agreed in writing.
Communication may take place through Instagram, Facebook, TikTok, email or any other platform through which the booking was arranged.
Paris Media is under no obligation to provide a personal telephone number or communicate through alternative channels.
The Client is responsible for maintaining access to the agreed communication channel and ensuring that messages can be received.
If the Client becomes unreachable for more than thirty (30) minutes, Paris Media may treat the booking as a no-show and terminate the session without refund.

   7.     WEATHER, LOCATIONS & SHOOTING CONDITIONS
The visual outcome of a session depends on numerous factors beyond the control of Paris Media, including weather, natural light, seasonal variations, crowds, traffic, construction work, security restrictions and public activity.
The decision to proceed with a session despite weather conditions constitutes acceptance of those conditions and their potential impact on the final result.
Variations in lighting, atmosphere, visibility, weather, location conditions or public access shall not be considered defects and shall not constitute grounds for refunds, discounts, reshoots or compensation.
Paris Media may adapt locations, routes, timing and creative approach whenever reasonably necessary.
The Client acknowledges that most sessions take place in public spaces where complete privacy, unrestricted access or the absence of other people cannot be guaranteed.
Paris Media shall not be responsible for restricted access, closures, construction work, demonstrations, filming activities, security measures, public events or any other circumstances affecting access to planned locations.
Weather forecasts are indicative only and may be inaccurate. Forecasted rain or adverse weather conditions shall not, by themselves, constitute grounds for cancellation or rescheduling. Unless otherwise agreed by Paris Media, Clients are expected to attend the session as scheduled. Any decision to proceed, modify or reschedule a session due to weather conditions shall remain at the sole discretion of Paris Media, taking into account the actual conditions on site.
Paris Media reserves the right to modify, shorten, suspend or terminate a session whenever reasonably necessary due to safety concerns, participant wellbeing, weather conditions, public events, transportation issues, location restrictions or any other circumstance affecting the proper execution of the service. Such adjustments shall not automatically give rise to any refund, credit or compensation.

   8.     CLIENT CONDUCT & RIGHT TO REFUSE SERVICE
Paris Media reserves the right to refuse, suspend or terminate a session at any time if the Client or any participant displays behaviour that is abusive, aggressive, threatening, harassing, intoxicated, unsafe, illegal, disruptive or otherwise unreasonable.
Paris Media reserves the right to refuse the use of any object, accessory or activity considered unsafe, illegal, disruptive or incompatible with the session.
Any termination resulting from client behaviour shall be considered a client-caused cancellation and shall not give rise to any refund, credit, rescheduling or compensation. The determination of whether behaviour is inappropriate or disruptive shall remain solely at the discretion of Paris Media.
Paris Media reserves the right to discontinue communications, refuse future services, cancel existing bookings, block communications channels or otherwise terminate any business relationship at any time where a Client, prospective Client or third party engages in abusive, aggressive, threatening, harassing, dishonest, bad-faith or otherwise inappropriate conduct. Any such decision shall remain at the sole discretion of Paris Media and shall not automatically give rise to any refund, credit or compensation.

   9.     CANCELLATION & RESCHEDULING
Cancellations made more than fourteen (14) days before the scheduled session date are eligible for a refund excluding all processing, banking and administrative fees.
Cancellations made within fourteen (14) days of the session date are strictly non-refundable.
Rescheduling requests submitted more than fourteen (14) days before the session may be accepted without charge.
Rescheduling requests submitted within fourteen (14) days may be refused or subject to a rebooking fee.
No refund, credit or compensation shall be granted for missed participants, missed locations, missed outfits, late arrivals, no-shows or any circumstance caused by the Client.
Force majeure events may result in rescheduling at the discretion of Paris Media.

   10.  CLIENT RESPONSIBILITY, PARTICIPATION & APPEARANCE
Clients are solely responsible for their appearance, clothing, makeup, hair, accessories and general preparation.
The Client is responsible for selecting appropriate clothing, footwear and accessories suitable for the weather conditions, season, location and duration of the session.
The Client acknowledges that the quality and variety of the final photographs and videos depend partly on their participation, cooperation, punctuality and willingness to follow reasonable instructions and creative guidance.
Paris Media does not guarantee that every photograph captured during the session will be suitable for delivery. The number of photographs taken during the session may exceed the number of final deliverables included in the purchased package.
Paris Media shall not be responsible for dissatisfaction arising from a Client’s refusal to cooperate, participate fully or follow guidance during the session.
Dissatisfaction regarding personal appearance, body shape, wardrobe choices, facial expressions or self-image shall not constitute grounds for refunds, reshoots, re-editing or complaints.
Portfolio images are illustrative examples of previous work and do not constitute a guarantee that identical results will be achieved for every Client, location or circumstance.
Photography and videography are subjective artistic services, and final creative decisions remain at the sole discretion of Paris Media.

   11.  COPYRIGHT, IMAGE RIGHTS & AI RESTRICTIONS
Paris Media retains full and exclusive copyright ownership of all photographs, videos and visual content produced.
The Client receives a non-exclusive, non-transferable licence for private personal use only.
Commercial use, advertising, publications, partnerships, sponsorships, resale, licensing or any use generating financial benefit requires prior written authorisation and a separate commercial licence.
The Client may not remove, alter or obscure any copyright notice, watermark, credit or attribution associated with the content.
The Client may not submit, distribute or otherwise use content created by Paris Media for the purpose of training, developing or operating artificial intelligence systems, machine learning models, synthetic media systems, facial recognition systems or similar technologies without prior written consent.
Any modification, enhancement, editing or processing of the delivered content by the Client or any third party after delivery shall release Paris Media from any responsibility regarding the final appearance or quality of the images.
Unless the Client opts out in writing before the session, Paris Media may use selected photographs and videos for portfolio, marketing, website, social media and promotional purposes.
Any unauthorised use of the content may result in legal action and financial damages.

   12.  SELECTIONS, GALLERY EXPIRATION & FILE RECOVERY
The Client is solely responsible for completing image selections, video selections and music selections before gallery expiration.
Failure to complete selections before expiration may result in permanent loss of access to selections and related materials.
All selections made by the Client are final. Once editing work has commenced, selected images and music selections may not be changed, exchanged or replaced.
Clients are solely responsible for downloading, storing and backing up all delivered content.
Once a gallery has expired, Paris Media is under no obligation to maintain, archive, recover or provide access to any files.
Files may be permanently deleted without notice after gallery expiration.
Recovery requests may be accepted solely at the discretion of Paris Media and are subject to a recovery fee starting at €100.
Recovery fees compensate administrative and recovery efforts only and do not guarantee successful recovery.

   13.  LIABILITY & LIMITATION OF LIABILITY
Paris Media shall not be liable for delays, interruptions or service failures resulting from circumstances beyond its reasonable control. 
In the event that Paris Media becomes unable to perform the service due to illness, injury, emergency or other unforeseen circumstances, Paris Media may, at its sole discretion, offer a replacement photographer or videographer, reschedule the session or provide another reasonable solution.
In the event of equipment failure or damage, storage media failure, data corruption, theft, illness, injury, force majeure or any other unforeseen circumstance preventing completion or delivery of the service, Paris Media’s liability shall be limited to the amount paid by the Client.
Under no circumstances shall Paris Media be liable for indirect, consequential, emotional, reputational, commercial or financial damages.
Clients remain solely responsible for all personal belongings, valuables, luggage, handbags, mobile phones, cameras, jewellery, watches, clothing, accessories and any other personal property brought to the session.
Any assistance provided by Paris Media in carrying, holding, storing, moving, watching over, temporarily handling or using such items is provided solely as a courtesy and free of charge and shall not create any duty of care, custody, safekeeping, surveillance, deposit, bailment or insurance obligation.
Paris Media shall not be liable for theft, loss, misplacement, damage, deterioration, disappearance, accidental damage, technical malfunction, loss of data, accidental deletion or unauthorized access affecting any personal property before, during or after the session, regardless of whether such items were temporarily entrusted to, handled by, carried by, used by or left near Paris Media.
Any transportation, travel assistance or travel arrangements provided, organised, recommended, booked or facilitated by Paris Media are offered solely as a courtesy and do not form part of the contracted services. Participation in any such transportation is entirely voluntary and at the Client’s own risk. Paris Media shall not be liable for delays, accidents, injuries, losses, damages, theft, disputes, service failures or any incident occurring during transportation, regardless of whether the transportation is provided by Paris Media, a third-party provider or arranged on behalf of the Client.
Paris Media’s total liability shall never exceed the amount paid by the Client for the relevant service.

   14.  DIGITAL PRODUCTS & NO REFUND POLICY
Photography, videography, editing services and digital files constitute personalised products created specifically for the Client.
Once editing work has begun, no cancellation, withdrawal, refund or reimbursement shall be available except where required by law.
Once photographs, videos, galleries, previews, edited files or digital deliverables have been provided, they shall be deemed accepted by the Client.
Unless expressly included in the purchased package, Paris Media has no obligation to perform revisions after final delivery.
If the Client downloads, shares, publishes, prints, reproduces, distributes, displays or otherwise makes use of any delivered photographs, videos or digital deliverables, such use shall constitute full acceptance of the delivered work.
Any courtesy, goodwill gesture, exception or additional service provided by Paris Media shall not modify the original agreement or create any entitlement to refunds, credits, discounts, compensation or future claims.
No refunds, exchanges, re-edits or compensation shall be granted on the basis of personal taste, artistic preference, subjective dissatisfaction, change of mind, dissatisfaction with one’s appearance or perceived differences from expectations.
The Client agrees not to initiate chargebacks, payment reversals or similar disputes for services already performed or digital products already delivered. In the event of a dispute, the Client agrees to contact Paris Media directly and allow a reasonable opportunity for review and resolution.

   15.  ACCESSORIES & THIRD-PARTY SERVICES
Accessories provided by Paris Media, including balloons, picnic setups, props, decorations and similar items, are offered either as optional add-ons or complimentary elements.
Paris Media shall not be responsible for defects, deterioration, theft, weather-related issues, damage or loss affecting such items before, during or after the session.
Third-party services, including dress rentals, makeup artists, hairstylists, florists, decorators, musicians, transportation providers, venues, hotels and event suppliers, operate independently from Paris Media.
Paris Media makes no guarantees regarding their availability, punctuality, flexibility, pricing, conduct, quality or performance and shall not be liable for disputes, losses, cancellations or damages involving such providers.
Any recommendation, referral or introduction made by Paris Media is provided solely as a courtesy. The Client remains solely responsible for selecting, booking and communicating with any third-party provider. Paris Media shall not be responsible for the availability, punctuality, flexibility, conduct, performance, pricing, cancellations or service quality of any recommended provider.

   16.  THIRD-PARTY INTERFERENCE
Paris Media is engaged as the exclusive professional photographer and/or videographer for the booked service.
Interference by third parties, including photographers, videographers, content creators, family members, friends or event guests, may negatively affect the quality, efficiency and outcome of the session.
Paris Media reserves the right to pause, modify or terminate portions of the session affected by such interference and shall not be responsible for missed photographs, missed footage, delays or reduced content resulting from it.

   17.  MINORS, PETS & HEALTH CONDITIONS
For participants under the age of eighteen (18), the booking Client confirms that they are the parent, legal guardian or authorised representative and have obtained all necessary permissions and consents.
Clients bringing pets or animals remain fully responsible for their supervision, behaviour and welfare at all times.
Paris Media shall not be responsible for any delay, disruption, reduced productivity or reduced content resulting from the behaviour of animals brought to the session.
The Client is solely responsible for determining whether all participants are physically capable of participating in the session and shall inform Paris Media in advance of any relevant medical condition, injury, disability, mobility limitation or pregnancy that may affect participation.
Paris Media shall not be liable for injuries, accidents, illness, fatigue, physical discomfort, animal-related incidents or other health-related issues occurring before, during or after the session.

   18.  CLIENT COMMUNICATION, REVIEWS & DISPUTE RESOLUTION
The Client agrees to communicate concerns, complaints or disputes directly to Paris Media and allow a reasonable opportunity for review and resolution before initiating formal proceedings.
Nothing in these Terms restricts the Client’s right to leave honest reviews or express genuine opinions in good faith.
The Client is expected to cooperate in good faith throughout the entire booking process, including communications before, during and after the session.
Any accommodation, alternative solution or additional service offered by Paris Media shall not be interpreted as an admission of fault, defective performance or contractual liability.
Threats, coercion, intimidation, extortion, blackmail or demands for refunds, products, services or compensation in exchange for withholding negative reviews may result in the immediate termination of communications, the immediate suspension of any ongoing services, the cancellation of any remaining obligations of Paris Media, the refusal of any future services and the pursuit of all available legal remedies.
No refund, credit, compensation or goodwill gesture shall be granted in such circumstances.
Paris Media reserves all rights regarding false, misleading, defamatory or malicious statements.

   19.  ACCEPTANCE & MODIFICATIONS
By making a booking, paying a booking fee, accepting a quotation, using a payment link or otherwise engaging the services of Paris Media, the Client confirms acceptance of these Terms & Conditions in their entirety.
Paris Media reserves the right to modify or update these Terms & Conditions at any time.
Any revised version shall apply only to bookings made after publication of the updated Terms & Conditions.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

   20.  GOVERNING LAW & COMPANY INFORMATION
These Terms & Conditions shall be governed by and interpreted in accordance with French law.
The parties agree to make reasonable efforts to resolve disputes amicably before initiating legal proceedings.
Any dispute arising from or relating to these Terms & Conditions or services provided by Paris Media shall be submitted to the competent French courts in accordance with applicable law.
